Terms and Conditions
Applicable to all our services as an artist, DJ, producer, beatmaker, instructor, and service provider.
Article 1: Definitions and Applicability
1.1 In these general terms and conditions, the following terms are used:
- Contractor: The artist, DJ, producer, beatmaker, instructor, and all-round music professional who applies these general terms and conditions and offers services.
- Client: The natural person or legal entity entering into or wishing to enter into an agreement for the supply of services, music sales, workshops, or lessons.
- Services: All performances, DJ sets, music productions, beats, sales of music (rights), workshops, private lessons, and other musical or creative services.
1.2 These terms apply to all quotes, offers, agreements, and deliveries of services or goods by the Contractor, unless explicitly agreed otherwise in writing.
Article 2: Quotations, Contact, and Establishment of Agreement
2.1 Because every musical assignment and collaboration is unique, a customized quote or invoice is prepared based on specific needs, preferences, and personal contact.
2.2 All issued quotes are non-binding and valid until the stated date, unless specified otherwise in the quote.
2.3 An agreement is established as soon as the Client agrees to an issued quote or invoice, or as soon as the Contractor actually commences the execution of the agreed service.
Article 3: Execution of Services
3.1 The Contractor shall perform the services to the best of their insight and ability, in line with the professional standards of an experienced artist and producer.
3.2 For performances, DJ sets, and workshops, the Client must provide the necessary facilities (such as pre-arranged technical equipment, space, or gear), unless agreed otherwise in writing.
3.3 Private lessons and workshops are scheduled by mutual agreement. In case of timely cancellation, a new date can be planned in consultation.
Article 4: Payment and Invoicing
4.1 Payment of quotes or invoices must be made within the term specified on the invoice (or standardly within 14 days of the invoice date).
4.2 If the Client fails to pay on time, they are in default by operation of law, and the Contractor has the right to charge statutory interest and any collection costs, as well as suspend work.
Article 5: Liability and Indemnification
5.1 In most cases and to the extent permitted by law, the Contractor is not liable for any direct or indirect damage (including lost profits, business stagnation, material damage to venue properties, or disappointing artistic results outside of control).
5.2 Should the Contractor unexpectedly be held liable for any damage, the total liability is at all times limited to a maximum of the invoice amount relating to the specific assignment.
5.3 The Contractor is not liable in case of force majeure (such as illness, technical failures, power outages, weather conditions, or other unforeseen circumstances making execution impossible).
Article 6: Intellectual Property
All rights to produced music, beats, compositions, and educational materials remain the property of Joe Evico , unless otherwise agreed in writing via an agreement.
Article 7: Applicable Law
7.1 All legal relationships and agreements are governed exclusively by Dutch law.
7.2 Any disputes shall preferably be resolved through mutual consultation. If this is not possible, they shall be submitted to the competent court in the region of the Contractor's registered office.
